To succeed in something of importance and value you must take action and not idle away as action speaks louder than words. Though knowledge is important because in some aspects as you cannot be illiterate about your cause if you wish to succeed. Knowledge is a key aspect of human beings. In order to advance in our society you must gain knowledge. Therefore to take action you must have a basis of information in order to be successful. You should not act in haste or proudness but rather develop your ‘pool of information’ and make an informed decision to acquire your desired results, â€Å"ignorance is the curse of God; knowledge is the wing wherewith we fly to heaven†. Some may say that taking action is more important than acquiring knowledge. They may say that people may spend too much precious time on gaining knowledge and miss there time of action. ‘History does not remember those who were knowledgeable but rather those who took action in a steadfast manner.’ Though I must disagree. History are full of those who carelessly and in alacrity took an ill-informed decision that was destructive on humanity. For example in when Lenin, the first leader of communist Russia died, his testament was not read out in public. This testament would have kicked Stalin out of the Communist Party and therefore would have stopped the mass murder that happened due to Stalin’s orders under his reign. Due to the ill-thought Trotsky and other high members of the Bolsheviks, the decision was to not read out the testament in public. This enabled Stalin to take power and soon Stalin became a despotic leader of the communist parties and created a terror in Soviet Russia as well as the rest of the world. Therefore I believe knowledge is of key importance. This is due to the timeless evidence of how acquiring knowledge is more important than taking knowledge, like the testament of Lenin and this story; There once was a man named Pars. He was thought to be slow as before making every decision he would sit and ponder about the connotations and effects this decision would have on him and his fellow classmates.

During my first semester I was often required to miss school by my parents, reason being that I had to help out in the movement process and had to visit an ill uncle out of town. I take full responsibility of my underperformance during the first semester of my senior year and am not look to make excuses. My main goal in making this letter is just to offer insight on what it is I believe influenced my underperformance. The History of English Legal System Essay I would like, therefore to discuss about the History of The Juries System, the roles and the composition of Juries System on how it was brought to the ENGLISH LEGAL SYSTEM. Firstly the modern jury derives out of the ancient custom of many ancient Germanic tribes whereby a group of men of good character was used to investigate crimes and/or judge the accused. The same custom evolved into the Vehmic Court system in medieval Germany. In Anglo-Saxon England, juries investigated crimes. After the Norman Conquest in 1066, some parts of the country preserved juries as the means of investigating crimes. The use of ordinary members of the community to consider crimes was unusual in ancient cultures, but was nonetheless also found in ancient Greece. The modern jury trial evolved out of this custom in the mid 12th century during the reign of Henry II. Juries, usually 6 or 12 men, were an ancient institution in some parts of England. (Henry II 286) Members consisted of representatives of the basic units of local government—hundreds (an administrative sub-division of the shire, embracing several vills) and villages. Called juries of presentment, these men testified under oath to crimes committed in their neighborhood and indicted. The Assize of Clarendon in 1166 caused these juries to be adopted systematically throughout the country. The jury in this period was self-informing, meaning it heard very little evidence or testimony in court. Instead, jurors were recruited from the locality of the dispute and were expected to know the facts before coming to court. The source of juror knowledge could include first-hand knowledge, investigation, and less reliable sources such as rumor and hearsay. Between 1166 and 1179 new procedures including a division of functions between the sheriff, the jury of local men, and the royal justices ushered in the era of the English Common Law. Sheriffs prepared cases for trial and found jurors with relevant knowledge and testimony. Jurors found a verdict by witnessing as to fact, even assessing and apply information from their own and community memory — little was written at this time and what was: deeds, writs, were subject to fraud. Royal justices supervised trials, answered questions as to law and announced the courts decision which was subject to appeal. Sheriffs executed the decision. These procedures enabled Henry II to delegate authority without endowing his subordinates with too much power. (Henry II 293) In 1215 the Roman Catholic Church removed its sanction from all forms of ordeal — procedures by which suspects were tested as to guilt (e. g. , the ordeal of hot metal was applied to a suspected thief by pouring molten metal into his hand, if the wound healed rapidly and well, it was believed God found the suspect innocent, if not then guilty). With the ordeals banned, establishing guilt would have been problematic, had England not had forty years of judicial experience. Justices were accustomed to asking jurors of presentment about points of fact in assessing indictments; it was a short step to ask jurors if the accused was guilty as charged. (Henry II 358) An early reference to a jury type group in England is in a decree issued by Aethelred at Wantage (997), which enacted that in every Hundred the twelve leading thegns together with the reeve shall go out and swear on the relics which are given into their hands, that they will not accuse any innocent man nor shield a guilty one. The resulting Wantage Code formally recognized legal customs that were part of the Danelaw . The testimonial concept can also be traced to Normandy before 1066, when a jury of nobles was established to decide land disputes. In this manner, the Duke, being the largest land owner, could not act as a judge in his own case. [ One of the earliest antecedents of modern jury systems are juries in Ancient Greece, including the city-state of Athens, where records of jury courts date back to 500 BCE. These voted by secret ballot and were eventually granted the power to annul â€Å"Unconstitutional Law†, thus introducing judicial review. In modern systems, law is self-contained and distinct from other coercive forces, and perceived as separate from the political life of the community, but all these barriers are absent in the context of classical Athens. In practice and in conception the law and its administration are in some important respects indistinguishable from the life of the community in general. In 1730, the British Parliament passed the Bill for Better Regulation of Juries. The Act stipulated that the list of all those liable for jury service was to be posted in each parish and that jury panels would be selected by lot, also known as sortition, from these lists. Its aim was to prevent middle-class citizens from evading their responsibilities by financially putting into question the neutrality of the under-sheriff, the official entrusted with impaneling juries. Prior to the Act, the main means of ensuring impartiality was by allowing legal challenges to the sheriff’s choices. The new provisions did not specifically aim at establishing impartiality, but had the effect of reinforcing the authority of the jury by guaranteeing impartiality at the point of selection. The example of early 18th century England legal reform shows how civic lotteries can be used to organize the duties and responsibilities of the citizen body in relation to the state. This case was a benefit to the legal system, as previously judges would try to intimidate or even bully juries into convicting a defendant, particularly where the crime had political implications. Therefore the importance of the jury system is that it could acquit a defendant, even when the law demanded a guilty verdict and it showed defendants that the trial by jury was not only a protection against injustice but also a loophole whereby real criminals could escape from â€Å"2. Besides that this rule remains today with a more modern examples stating that judges must respect the independence of the jury as in R v McKenna(1960) this case† the judge had threatened the jury, who had been deliberating for about two and quarter hours, that if they did not return a verdict of guilty within another ten minutes they would be locked up all night†, hence Justice Cassels stated it is a cardinal principle of our criminal law that in considering their verdict, concerning as it does, the liberty of the subject, a jury shall deliberate in complete freedom, uninfluenced by any promised, unintimidated by any threat, because they still stand between the Crown and the subject, and they are still one of the main defences of personal liberty†3. The Jury System is considered as a need because it is a significance part of the English legal system, although only a minority of the cases is tried by the jury in these days. In a sense it plays an important role in ensuring that the criminal justice system works for the assistance of the public rather than for the benefit of disproportionate leaders. It promotes not only a fair criminal justice system but also a healthy society, where political leaders cannot misuse criminal justice system to silence their opponents, hence according to LORD DEVLIN which he has wrote on 1956 â€Å"trial by Jury is more than an Instrument of Justice and more than a wheel of the Constitution; it is the lamp that shows that freedom lives†4. Moreover, as many scholars and practitioners have commented over the centuries, the common law jury that develops in Britain was branched in other parts of the world as a UNIQUE INSTITUTION. Therefore Juries are, it brings all together a small group of lay people whom are assembled on a temporary basis for the purpose of deciding whether an accused person is guilty of CRIMINAL act or which of two sides should prevail in a CIVIL dispute. According to (Spooner,1852) â€Å"The central plank of trials within a jury based system is this: No free man shall be captured, and or imprisoned, or disseised of his freehold, and or of his liberties, or of his free customs, or be outlawed, or exiled, or in any way destroyed, nor will we proceed against him by force or proceed against him by arms, but by the lawful judgement of his peers, and or by the law of the land . 6 For an illustration, the Jury System reflects a democratisation of justice compared to a purely judicial system, it is merely necessary to consider the Socratic judgments of antiquity, or the very wide latitude given to Japanese judges today. The freedom of action and interpretation that is held by one individual in these cases has two primary problems. Firstly, justice is hugely dependent on the competence and impartiality of one person, with a single point of failure for corruption to be introduced. Secondly, judges have been of high social status throughout history, and thus can be criticised as having a possible lack of intuition and empathy with poorer defendants. This illustration is a practical example for the need of the Jury system. In addition, the jury is likely to have a greater experience of contemporary cultural trends and pressures then a judge who has spent 30-40 years in intense study of the law, and a correspondingly greater understanding and empathy with the actions of the parties involved in the case. A jury also often has far less of a stake in political issues†¦. Moreover the United Kingdom does have a somewhat unhappy history relating to judge-only proceedings, through the actions of the Northern Ireland Diplock courts. The Diplock courts were set up in 1972, with the brief of effectively intervening against terrorism. This very assumption could be seen to reflect the view that a purely judge based system was more likely to convict in these cases, and thus reflects the importance of jury trial in other cases. The Diplock courts, as might have been expected, then proceeded to be involved in several extremely contentious convictions, notably that of Christy Walsh. In this case, several sections of the trial were criticised for unfairness during the trial itself, with the defence faced by a judge apparently uninterested in this (British Irish Rights Watch, 2006)7. Therefore the Jury system could be fresh defence of injustice. According to Peter Jefferson, â€Å"We all know that permanent judges acquire an esprit de corps; that, being known, they are liable to be tempted by bribery; that they are misled by favor, by relationship, by a spirit of party, by a devotion to the executive or legislative; that it is better to leave a cause to the decision of cross and pile than to that of a judge biased to one side; and that the opinion of twelve honest jurymen gives still a better hope of right than cross and pile does. †8, this can be easily illustrated by the role of Lord Chancellor is the head of the judiciary and has a major role in the selection of judges, however he is also a member of the cabinet and the position is a political appointment decided on by the Prime Minister and the position has been strongly criticised as being involved in too many different functions of the State, besides that It has also been suggested that the Lord Chancellors selections of judges and also his special adviser could be biased because Lord Chancellor selected his special adviser from a small group he already knew, comprised mostly of white males.

Is Lying Under Any Circustances “Righ or Wrong”

Based on the philosophy of Immanuel Kant, I would have to disagree with his argument that lying is wrong under any circumstances. In this paper I will discuss my reason for disagreeing with the argument based on the flaw stated in the argument, how lying and telling the truth both have bad consequences depending on the circumstances, and also how moral rules cannot be absolute. In this paragraph I will be discussing the flaw that is stated in the argument, in which I absolutely agree with.The philosophy that â€Å" Kant† is stating is completely flawed because it is contradictory on what he base his reasoning on. â€Å" Suppose it was necessary to lie to save someone’s life. Should you do it? Kant would have us reason as follows: We should do only those actions that conform to rules that we could will to be adopted universally. Second, if you were to lie, you would be following the rule ‘ It is okay to lie. ‘ Also this rule could not be adopted universally, because it would be self-defeating: People would stop believing one another, and then it would do no good to lie, therefore, you should not lie. (Immanuel Kant). The problem would show in step two, on why we would be saying if we lied that we would be following a rule that it is okay to lie, when as Anscombe stated if you changed it around to â€Å" I will lie when doing so would save someone’s life. † That would make that rule not be self-defeating. Ancombe's argument,shows that in order not to lie completely and prove Kant’s philosophy you have to show where lying would not have a good consequence behind it. But it clearly shows that depending on what you are lying for some lies can help more than hurt.Which leads me into my second point on how lying and telling the truth both has bad consequences. In Kant’s philosophy telling the truth leaves you blameless no matter what the outcome of the truth. And lying leaves you being held responsible for the out come no matter good or bad. This to me is not a good philosophy because you cannot be blameless if telling the truth gets someone killed, but lying helps save his or her life. Because you had to lie in order to save that person’s life does that make you less heroic? No. To me it shouldn’t matter as long as you did what you had to do to help hat person stay alive. A lie can have harmful consequences you can get someone hurt by lying: and saying that a person did something can get them fired from work. But you can also tell the truth about a person and her actions and still get her fired from work. Both have bad consequences and it doesn’t make that person feel any better about whether the outcome came from lying or telling the truth. And that shows how lies and truths both have bad consequences. A moral rule cannot be absolute to me because we don’t live in a society that makes decisions based on morals.Because there is some circumstances that make it hard to say that when this person lied it doesn’t matter that the outcome helped someone it was just a lie and nothing else matters. That is not the reality of things morally; you cannot let a person die and feel good about yourself just because you told the truth. Making a moral rule absolute would be contradictory to Kants philosophy, tell the truth no matter what; but morally, is it right to let someone that you can help with a lie fall by the waste side?You may have morally told the truth, but you also feel responsible morally no matter how righteous telling the truth may have been. If you ask me if a moral rule was absolute there would be terrible consequences to telling the truth and not lying in certain circumstances. If such dilemmas occur, then doesn’t this disprove the existence of absolute moral rules? Suppose, for example the two rules â€Å" It is wrong to lie† and â€Å" It is wrong to facilitate the murder of innocent people† are both taken to be absolute?The Dutch fishermen in Kant’s argument would have to do one of these things; therefore, a moral view that absolutely prohibits both is incoherent. You cannot in my opinion say that as long as you tell the truth no matter what the consequences are would leave you blameless, if when telling a lie would help someone. But just because it is morally wrong to lie it doesn’t matter of that consequence you are still wrong even though lying saved that person’s life.If you ask me it would be morally wrong to let a person die and not do everything in your power to save that person. Which is why I don’t feel like a moral rule should be absolute and why in both circumstances of lying or telling the truth you really never know what outcome you are going to get. It is a choice that you make based on the situation that you are in, a nd even when telling the truth the outcome can still be bad. Virinder Kaur POLS 202-01: International Relations Reaction Paper #1: Of Syrian Wars and US Foreign Policies Due: October 4, 2012 Modern Syria first gained its independence in 1946, following many years of violent strife. Before this, the state had been under a French Mandate and had suffered under a conditional (or more aptly, false) independence, wherein the French State held veto power over any potential laws introduced by the Syrian people (US Dept. of State). In 1970, the Baath party came into political power in Syria in yet another bloody coup-d’etat, with Minister of Defense, Hafiz al-Assad, taking up the mantle of President (US Dept. f State). He would remain in power up until his death in the year 2000. This would ultimately result in the appointment of his son, Bashar al-Assad, to the presidency, a position that would once more see civil malcontent and intrastate violence (US Dept. of State). Over the past 18 months, there have been ongoing violent conflicts in Syria between the Syrian government and various groups of rebel fighters (US Dept. of State). According to BBC News, this extremely bloody conflict within the state has instigated a multitude of international war crimes on the side of both the government and the rebel groups involved.The civil war in Syria began in mid-March of last year when citizens first openly protested against Assad’s administration (US Dept. of State). Shortly following the Syrian Army’s continued violent suppression of the protests, the situation quickly turned to armed rebellion, ultimately leading to 18 months of violent assault on the citizens of Syria by its government and by rebel/terrorist groups (US Dept. of State). These continued violent uprisings in Syria are in no part a failure on the part of the United States foreign policies. In fact, the United States played very little role where the start of this conflict is in question.Beyond its support of the protestors’ cry for democratic proceedings, the US was not responsible for instigating violence on either front. Furthermore, the United States was openly critical of Assad’s earlier reaction to what had started out as peaceful protests. According to Al-Monitor News, the US financially supported the opposition to the Syrian government by granting a waiver to a Free Syrian Army (FSA) support group, also called the Syrian Support Group, or SSG, which is an NGO aiming to provide the FSA with intelligence, communications, and financial support (Rozen).The US, like most governments, is reluctant to strike any arms deals or provide lethal aid to the FSA and other loosely organized militant groups as they cannot control the violence of all of their members (Frieden). Any intervention beyond this would be unreasonable and a hazard to state interests of which, according to realists, in the hierarchy of issues facing the state, national and international security is most important (International Relations Text, 40). Direct involvement in the conflict will only further incite the violence as intervention by foreign states is believed to cause, not prevent, rebellion (Frieden).Al Arabiya News maintains that the United Kingdom and France have also provided similar support for the Syrian opposition. The UK offered monetary assistance and France offered non-lethal military aid (Al Arabiya). France, in particular, was adamant against becoming directly involved in the bloody conflict without UN support. Instead, it provided â€Å"means of communication and protection† for the FSA (Al Arabiya). France justifies its determination to avoid direct involvement by reiterating the mistake George W.Bush made when he independently decided to invade Iraq. France had also opposed that proposal and, in time, had proven correct (Al Arabiya). Russia and China, on the other hand, are vehemently opposed to the UN’s resolution to impose force and economic sanctions, believing they are measures taken by American and European states to further assert their power over Syrian sovereignty or as a means to line the US Treasury and EU banks, according to George Lopez, a professor of Peace Studies at the University of Notre Dame (Lopez).However, the people of Syria are rebelling against the Assad regime, from which it can be inferred that the legitimacy of the Syrian government is already under question. Russia, in particular, is against UN intervention in Syria, predominantly in providing aid to the rebel groups. As stated in the The Moscow Times, this is because Russia has strong economic ties to Syria; due to its’ economic and military interests in Syria, Russia will not rescind its support of the Syrian government in favor of the anti-Syrian government sentimentalists (Amos).Russia’s economic interests include its billion dollar arms contracts with the Syrian government and its military interests lie in the Russian navy base in Tartus, which is â€Å"Russia’s las t base beyond the borders of the former Soviet Union (Galpin). † According to BBC, China has also blocked many UN proposed economic sanctions on Syria, a decision that reflects China’s Communist leaders’ concern that the West is trying to provoke a regime change in Syria under the guise of humanitarian action.This regime change could ultimately threaten China’s economic interests in Syria, its oil interests, in particular. Such civil wars and intrastate conflicts between rebel groups and the government can be resolved through diplomatic negotiations that can avoid these expenses (Frieden).The US is not financially secure enough to engage in yet another bloody conflict in the Middle East, particularly one as convoluted as the one in Syria. Self introduction Essay Everyone has his characters to lead him to success. In other words, characters such as cheerful are unique and these are the factors to make them achieving their goal. In my case, I am stubborn to do anything, including my study even playing basketball. In my secondary school life, my teacher told me that I was headstrong and enlarged the unhappiness to make my emotion in trouble. I just realize what he told me before when I faced my HKAL exam but I find that this character can guide me to reach my goal. To get in University, I spent so much time on it and I encounter many problems and failures, especially in English. However, obstinacy helps me to tackle with the problems and finally I achieve my aim. I kept spending over 10 hours every day around a year to prepare my HKAL exam when I was form 7 student. I expected I can get a good result in the exam but unfortunately I was fail in my UE subject. This made me to be disappointed and helpless because the HKAL exam was replaced by the DSE exam. It means that there are no second chances for HKAL candidates to retake the exam and they have to seek other ways to continue their studies. Without any option, associate degree is my only way to reach my goal and I planned to spend a year to obtain a degree offer. Finally, the dream comes true and I can major in my favourite subject. Obstinacy causes me to keep chasing my goal even I faced many problems and failures. Sometime it motivates a person to keep moving on and achieve success. However, stubborn character makes my emotion in trouble duo to the enlargement of the sadness. I always recall the unhappiness and enlarge it by my imagination. In fact the issues may not be that negative as I think and I am not willing to seek any help. My mental health is suffered by this character and I have to learn to deal with it. Over insisting on my point also is one of my drawbacks. Sometimes when I discuss or work with others to make a consensus, I take a firm stand on my view and do not want to consider the others’ ideas. Thus the teamwork and morale are damaged by the conflicts Even I am suffered by the obstinate character, it practices me to be tough to cope with problems. It also benefits my future career in education. I can share my experience about how to face the failures to encourage students to  pursue their goal. Also obstinacy can help me to tackle with the problems as I faced before. Obstinacy is not just a negative impact for a person. For me, it also motivates me to move on and helps me to reach my goal.
